In court documents seen by World Sunday Thembekwayo tried to develop the property, but was unable to do so.

“However, Palesa ignored my promise to sell the property. Since the beginning of 2021, at least three attempts have been made to restructure the loan with the first respondent. The impact of Covid on my finances, as well as the need to support two households has affected my income,” read the court papers that appeared in that publication.

In arrears

Thembekwayo said his wife was aware of his financial problems and said he did not want to restructure the property loan with FNB. He said this culminated in FNB taking legal action against him to attach and sell the property in October last year.

He further stated that Mahlolo contacted him via email, asking why the property was being sold and if it was because of non-payment.

“I spoke with Palesa and we agreed that the property will be sold. This agreement is because I persuaded him that if the second respondent is executed on the property, we will lose all profits, he said.

The estate agent tried to communicate with Maholo without success. “At every turn, I follow Palesa, usually by phone, who has promised to be in touch or come in, but he has never done anything like that.”

Due to the delay, the offer from the potential buyer expired but Thembekwayo still wanted to sell the property.

The businessman said FNB is taking legal action against him and Maholo for outstanding payments and is in the process of declaring the property enforceable.

The bank reportedly wants to recover R1.3 million, but still hopes that with an offer such as R3.6 million, they can still make a profit from selling the property located in Steyn City.

The Warga has reached out to Thembekwayo for comment and is awaiting a response.
