The Jan. 6th Select House Committee Voted To Refer Former President Donald Trump To The Department of Justice For Criminal Investigation and Potential Prosecution For Trying To Overturn The 2020 Election (CNBC Politics,Dec. 19, 2022). The witness testimony included in the committee’s report was largely provided by Republican members of Trump’s inner circle. Former lawyers, White House staff members and members of the administration provided the committee with eyewitness accounts of Trump’s knowledge that he was losing the election and his understanding and support of attacks on the Capitol by his supporters. The following documentation from the January 6 report supports the committee’s referral to the Justice Department to pursue an investigation and potential charges against Trump:

• OBSTRUCTION OF OFFICIAL PROCEEDINGS: Trump violated Section 1512 of Title 18 of the U.S. Code when he sought to “prevent or delay the counting of Electoral College votes certified as valid from several States,” personally and repeatedly pressured Vice President Mike Pence to refuse to count the votes election (December 21, 2022, Fact check.org). The committee also found Trump responsible for recruiting tens and thousands of armed followers to attack the Capitol, and “fight like hell, to save our country.”
• CONSPIRACY TO DEFEAT THE UNITED STATES: Trump “entered into agreements with individuals to obstruct the legitimate functions of the government (certification of elections).” The report also found Trump “Trump and his co-conspirators” used ‘deceptive or dishonest means'” in an attempt to block the election certification. • CONSPIRACY to make false statements: This reference to Trump conspiring with others “to submit false voter slates to Congress and the National Archives. Section 1001, Title 18 defines a member of the government who “knowingly and willfully — (1) falsifies, conceals, or conceals trick, scheme, or material fact device; (2) make a materially false, fictitious, or fraudulent statement or representation; or (3) make or use any false writings or documents knowing they contain materially false, fictitious, or fraudulent statements or entries. • AIDING, AIDING OR AIDING AND ENTERTAINING INSURRECTION: Members of the committee stated that the available evidence shows that Trump violated 18 USC 2383, which applies when a person “invites, abets, aids, or participates in rebellion or insurrection against the authority of the United States or its laws , or offer help or comfort. The committee said Trump called supporters to the Capitol, told them to fight like hell to take their country back, and told the crowd that “Mike Pence did the right thing, we won the election.”

This investigation along with the Mara-a-Lago stolen documents investigation is now in the hands of DOJ special counsel Jack White. A list of witnesses, mostly republicans volunteered or cooperated with the committee by giving eyewitness accounts of Trump knowing about the violent mob that would come to the Capitol to do whatever he asked, From the moment Trump realized that the crowd was shouting “hang MIke Pence” him must act to remove the rioters from the Capitol. He didn’t do the deed, therefore, lives are threatened and something is lost because Trump’s ego needs to see that he is still loved and respected. Watching their supporters nearly destroy our democracy inflates their self-esteem and encourages the “big lie” narrative.
