In case you didn’t know, the 38-year-old was convicted on January 3, 2022, of defrauding investors out of millions through a health care startup. Theranos. He falsely claimed that revolutionary technology could perform hundreds of medical tests with just a few drops of blood. It later came to Holmes’ head while on The Wall Street Journal reported in 2015 that the machine he was selling, called Edison, never really possible. Instead of using the correct machine, the company uses external technology and other tricks to make the test result false positive. During his trial, his attorney tried to convince jurors that he knew nothing and had never lied to investors. The outspoken founder even testified that his decision was off the table because he was in the midst of an abusive relationship with a former Theranos executive. Ramesh “Sunny” Balwani. However, the jury isn’t buying it. He later found him guilty of three counts of wire fraud and one count of conspiracy to commit wire fraud. While he has since appealed the sentence and is due to begin sentencing on April 27, prosecutors are demanding that he not be allowed to remain free on bail. Why is that? According to court filings Thursday, the government learned that weeks after the indictment, Holmes had purchased a ticket to fly to Mexico on Jan. 26, 2022 — with no return flight scheduled. Prosecutors claimed in the filing, people reported:
“The Government learned on January 23, 2022, that Defendant Holmes had booked an international flight to Mexico departing on January 26, 2022, with no return schedule.”
When one of the prosecutors reached out to Holmes’s lawyer Lance Wadehe claimed in an email that he had booked a flight for a close friend’s wedding before the jury’s verdict and hoped to travel if he was found not guilty:
“Hopefully the verdict will be different and Ms. Holmes will be able to make this trip to attend a close friend’s wedding in Mexico.”
He later said that Holmes had forgotten to cancel the reservation “in the midst of everything that was going on” but vowed to do so. However, prosecutors did not believe his story and felt he was trying to flee the country. The motion reportedly contradicts:
“It was only after the government raised this unauthorized flight with defense counsel that the trip was canceled.”
Per peopleprosecutors said they planned for Holmes to respond “if he didn’t leave the country as scheduled” but that he found it “difficult to know with certainty” if he would have escaped without someone coming in. fleeing has never been higher” and Holmes “has a way of acting on that incentive.”
Furthermore, the submission notes that her husband, Billy Evans, left the country on a January 26 flight to Mexico and returned six weeks later, flying back from Cape Town, South Africa. Adding to that argument, prosecutors felt Holmes “continues to show no remorse for his victims” — especially those who lost millions in their investment in Theranos.
